In our previous blog post on this subject (July 2022) we reported on a proposed amendment to the UKCA legislation (that had not yet been voted on by the UK Government) that would have allowed EU Notified Body ATEX Certificates to be used in lieu of UK Approved Body certification, in order to apply the UKCA mark to a product ahead of the 1st January 2023 deadline.
This amendment was never voted through, in part because of concern that it would lead to two-tier UKEX approvals: some by Approved Bodies and some, essentially by self-declaration. Instead, the deadline for UKCA marking, backed by full UKEX approvals, has been moved on for a second time, now to 31 December 2024. In the meantime, CE marking, backed by ATEX approvals, will continue to be allowed in Great Britain.
